Man ended up with fractured skull after hurling abuse at a woman

A man suffered a fractured skull when he was punched after hurling vile and explicit abuse at another man’s partner.

Daniel Cuthbert admitted unlawful wounding of the victim at around 7pm on May 16 last year in a Grimsby town centre street.

He snapped after repeated allegations were made against Cuthbert’s partner for watching “dirty old men” on video and watching pornographic videos.

She was with her daughter at the time and walked away but the comments continued until Cuthbert punched him.

The court heard how the blow knocked him over and he landed hitting his head hard against a kerb.

Cuthbert’s partner called 999 and ambulance crews were quickly on the scene along with police. The man was bleeding from his head and was taken to hospital with life-threatening injuries.

Cuthbert was sat smoking and said to officers that he hoped the man would be well treated.

The victim remained in hospital at a specialist unit at Hull Royal Infirmary for three days for the surgeons to remove a blood clot.

Cuthbert, of Winchester Avenue, Grimsby had 10 previous convictions for 17 offences, including affray and assault.

The defense added that there was no weapon involved in the incident and that there had been no trouble since then.

The defendant had worked ever since leaving school and is devoted to his children and partner, with the defense adding there had been a “sea change in his behaviour.”

Sentencing Cuthbert to 18 months in prison, Record Tahir Khan QC, said he would suspend the sentence for two years because the defendant was minding his own business with his partner and eight-year-old child.

He added the injury was life-threatening which justified a considerable sentence.

Record Khan said the man will make a full recovery and it was clear from what Cuthbert said at the scene to officers, that he was sorry and concerned for his welfare.

He ordered Cuthbert to carry out 240 hours of unpaid work and 15 rehabilitation activity days.
