Trial of Indian Restaurant boss accused of rape begins.

Mohammed Uddin 45 of Augusta Street has gone on trial at Grimsby Crown Court accused of raping a woman who claims she is a lesbian on Cleethorpes beach. He denies rape and an alternative charge of assault by penetration on August 21st.

He is claiming that the woman consented but it is believed that the woman is a lesbian and does not like men. The 36-year-old woman was in a relationship with another woman. The woman had been out drinking with her girlfriend and sister but there was a disagreement.

She then left her girlfriend’s house and bought vodka and coke and went to Cleethorpes beach and began drinking alone at 11.15 pm. It was there that the alleged rape took place. the rape is alleged to have taken place at 11.45 pm. CCTV pictures show Uddin walking around the promenade earlier and driving off in his car at 11.52 pm. Two people who were on the promenade in a car heard a commotion and one of them heard the woman screaming. It seemed that she was drunk and they then became concerned something was not right. A council mobile patrol officer was alerted and the officer saw the woman with her top pulled over her head and no clothes on her bottom half. She did not know how she had got there. Police were alerted and she told them she had been saying help me, help me but no one was there she had been drinking heavily.

The woman claimed that Uddin asked for sex and told her he was a nice guy. She alleged that Uddin exposed himself to her before talking about sex and saying give me a sh*g but she did not know whether he did so. Swabs from the woman revealed his DNA which indicated that he had sex with her.

But she described herself as a lesbian and claimed that it is not something she would do. He claimed that the woman pulled him on top of her and asked him for sex. Uddin was identified from his car which had been seen in the area.

The trial continues and is expected to last four days.
